House rules

The following house rules apply to the entire premises of Bergson Kunstkraftwerk as well as to the associated open spaces and parking lots.

1. parking regulations

1.1 The rules and signs of the German Road Traffic Regulations (StVO) apply in the parking lots of the Bergson Kunstkraftwerk.
1.2 The parking lot is partially under video surveillance. Data is processed in accordance with the provisions of the General Data Protection Regulation (GDPR). Further information can be found on our website at www.bergson.com/datenschutz.
1.3 Vehicles may only be parked within the designated parking areas. In the event of improperly parked vehicles that obstruct traffic, Bergson Kunstkraftwerk will be forced to have them towed away at the expense and risk of the vehicle owner.
1.4 The parking fee is only charged for providing a parking space and not for guarding the vehicle. Doors, trunk, windows and sunroof must be kept closed. Please do not leave any valuables visible in the vehicle and do not leave any animals in the vehicle.
1.5 Parking in the designated disabled parking spaces is only permitted with valid proof (e.g. disabled parking permit or parking authorization sign). Any violation may result in measures such as towing, which will be at your own expense and risk.
1.6 Bergson Kunstkraftwerk accepts no liability for theft of or damage to vehicles by third parties. This also applies to damage caused by storm, fire, hail, explosion or other extraordinary events. Damage allegedly caused by employees of the Bergson Kunstkraftwerk must be reported immediately after discovery and, if possible, during the visit, insofar as this is reasonable. Bergson Kunstkraftwerk is only liable for any fault of its employees in cases of intent or gross negligence.

1.7 If the parking ticket is lost, a fee in the amount of the currently valid maximum daily rate will be charged.

2. admission authorization

2.1 The Bergson Kunstkraftwerk site may only be entered at the designated visitor entrances.

2.2 Admission tickets for cultural events must be kept during the visit and presented on request. Authorization to enter and remain on the grounds of Bergson Kunstkraftwerk is valid during the designated general opening hours. If the Bergson Kunstkraftwerk premises have to be closed prematurely for technical, organizational, operational or weather-related reasons for which the Bergson Kunstkraftwerk is not responsible intentionally or through gross negligence, there is no right to a full or partial refund of the admission price.

2.3 If you leave an event only briefly during the performance, please contact one of our employees at the entrance control so that you can be granted access to the room again later.

2.4 Children who have not reached the age of 12 are only authorized to enter together with an accompanying adult of legal age. Supervisors and parents are liable for their children. Other rules may apply for certain events. Please note the relevant information on the respective events. The relevant brochures, websites and, of course, the staff at Bergson Kunstkraftwerk are available for this purpose.

2.5 The sale of vouchers, admission tickets or free tickets for the Bergson Kunstkraftwerk in the parking lot or on the grounds of the Bergson Kunstkraftwerk is not permitted.

3 General safety regulations

3.1 The instructions of the Bergson Kunstkraftwerk staff must always be followed in your own interest.

3.2 All visitors are required to behave correctly and appropriately. Disturbance of public order, willful destruction or soiling, improper behavior, interference with other guests or the operation, use of verbal or physical violence, insult, abuse, disregard of the house rules, etc. will prompt the Bergson Kunstkraftwerk to take appropriate measures such as expulsion, filing a complaint or similar. The Bergson Kunstkraftwerk also reserves the right to expel visitors whose behavior suggests that they could endanger or disturb themselves or others from the premises without compensation.

3.3 The possession and carrying of weapons, dummy weapons or dangerous objects, fireworks or other pyrotechnic objects as well as any kind of discriminatory, violence-glorifying or anti-constitutional objects or insignia is not permitted on the grounds of Bergson Kunstkraftwerk.

3.4 It is not permitted to take along or operate drones or any kind of remote-controlled toys and devices.

3.5 Bulky and oversized items such as large suitcases may not be taken into the Bergson Kunstkraftwerk. Backpacks and handbags may not be left unattended. A checkroom is available for your personal belongings for a fee.

3.6 Willful noise or the loud operation of music equipment is prohibited. Objects that may disturb the public peace, such as megaphones or horns, may not be taken onto the premises or operated.

3.7 The fire regulations in the Bergson Kunstkraftwerk must be strictly observed. Smoking is prohibited throughout the building. This also includes e-cigarettes and e-shishas. Please be considerate of your fellow human beings. The Bergson Kunstkraftwerk buildings are equipped with an automatic fire alarm system (BMA). Any activation of the fire alarm system due to non-compliance with fire regulations, for example unauthorized smoking indoors, will be prosecuted. Any costs incurred will be borne by the perpetrator.

3.8 Escape and rescue routes are marked as such. These must be kept clear at all times.

3.9 Entering the marked stage, scenery, backstage and supply areas is not permitted. Barriers, fences and walls may not be climbed over.

3.10. Due to weather conditions (rain, freezing rain, natural snowfall, etc.), there may be a risk of slipping on the grounds of Bergson Kunstkraftwerk. Guests are therefore advised to exercise the necessary caution and care on the entire site, i.e. to observe barriers with ropes, fences, trees, etc., to wear non-slip footwear, to refrain from fast walking and running and to use the handrails provided.

3.11. The wearing of masks or the complete covering of the face (disguise) is prohibited. Veiling for religious reasons is permitted. The wearing of medical masks is excluded from this regulation.

3.12. With the exception of guide dogs, animals may not be taken into the Bergson Kunstkraftwerk building. In outdoor areas, dogs must be kept close to their owners.

3.13. The bringing of alcohol, the possession or consumption of illegal narcotics and aids to their consumption is prohibited and will be punished accordingly.

3.14. Persons under the influence of alcohol or drugs may be expelled from the Bergson Kunstkraftwerk premises.

3.15. It is forbidden to search through waste, collection or collection containers. The contents of the containers provided for this purpose are the property of Bergson Kunstkraftwerk. Any removal or removal from the site is prohibited.

4 Use of the rooms and facilities

4.1 The rooms and facilities in the Bergson Kunstkraftwerk are available to visitors within the framework of the respective usage regulations and intended purpose.

4.2 The opening hours of individual rooms and facilities may deviate from the general opening hours of the Bergson Kunstkraftwerk.

4.3 After 10 p.m., we urgently request quiet in the outdoor areas, especially in the parking lots when leaving the Bergson Kunstkraftwerk.

4.4 Certain areas and facilities are only seasonal in nature or may be closed due to construction and maintenance work or for operational or organizational reasons. These closures may also be carried out without prior notice.

4.5 The use of playground equipment and similar facilities is at the user's own risk. Adults are not permitted to use playground equipment on playgrounds. Special age regulations governing the permitted group of users are binding and must be observed. Parents are liable for their children.

4.6 Touching any works of art in all rooms of the Bergson Kunstkraftwerk is prohibited. In the event of damage, the perpetrator is liable.

4.7 Visitors are liable for all damage caused by disregarding the rules of use, e.g. by willful damage.

4.8 In times of pandemics or other special situations, you are obliged to comply with applicable legal and official regulations, such as the obligation to wear a mask or social distancing rules. If you do not comply with these regulations communicated by us or our employees, we reserve the right to assert our domiciliary rights. Likewise, there is no right to compensation for persons who cannot visit the Bergson Kunstkraftwerk despite having a valid ticket because they personally do not meet a legal or official requirement, e.g. the required vaccination status.

5. duty of supervision

Parents and accompanying persons are advised that they must carefully fulfill their duty of supervision. Furthermore, they are responsible for all damage caused by those being supervised, even if the supervisor is not present on site on the day of the visit.

6 Advertising and offering goods and services

Advertising on the premises of Bergson Kunstkraftwerk or the offering of goods and services is only permitted with the prior written consent of the management. This also applies to the conducting of opinion polls and censuses. Uncoordinated advertising and announcements for organizations, associations, interest groups or personal ideas by any means whatsoever are prohibited on the premises and inside all buildings and will be punished in individual cases with expulsion from the premises, civil claims and criminal charges for trespassing.

7 Video surveillance, filming and photo shoots

7.1 The Bergson Kunstkraftwerk is under video surveillance. The surveillance serves to ensure the safety of visitors and employees and to protect the facilities and equipment.

7.2 Insofar as film and photo recordings are made in the Bergson Kunstkraftwerk for television programs, advertising or other occasions, the corresponding areas are marked or this is easily visible. Visitors are free to avoid these areas during the production period of the respective recordings.

7.3 In the event that image, video and / or sound recordings are made on the premises and / or in the Bergson Kunstkraftwerk by persons authorized to do so by the Bergson Kunstkraftwerk, visitors agree by their visit that they may be recorded in image, video and sound and that these recordings may be broadcast or published without any claim to remuneration. published without any claim to remuneration.

7.4 Own photo and film recordings for private purposes are permitted, provided that other guests are not affected or disturbed by this. The production of image and sound recordings during a performance (concert, reading, lecture or similar formats) is prohibited. Sound, film and video recordings of the event are generally not permitted, even for personal use. Infringements may give rise to claims for damages or result in measures being taken. Bergson GmbH accepts no liability whatsoever in the event of infringement of these provisions, in particular in the case of publication of recordings of performing artists on the Internet or similar.

9 Transfer of rights when purchasing or obtaining a ticket

When the ticket is handed over, Bergson GmbH is irrevocably authorized to make or produce image and sound recordings of the visitors:(1) to make or have made video and audio recordings of the visitors and receives the exclusive, temporally and geographically unrestricted right, free of charge, to use these recordings in full or in excerpts as often as it wishes on television.(1) on television and on the Internet, irrespective of the technical transmission method, the type of receiving device, the broadcasting station and the gratuitousness vis-à-vis the consumer:(2) to make available to users for individual retrieval by means of a television set, computer or the like ("TV").("on-demand"), (3) to distribute for non-broadcast audiovisual exploitation on image/sound carriers, (4) to archive and (5) to use within the scope of all technically as yet unknown types of use. 10. controls of visitors

10.1 Visitors who wish to enter the Bergson Kunstkraftwerk within the scope of these house rules expressly agree to voluntarily submit to a possible check by the security service. The instructions of the security service must be followed in full, otherwise access will be denied. The security service deployed is entitled to examine persons to determine whether they pose a security risk due to alcohol/drug consumption or because they are carrying weapons or dangerous objects. Every guest expressly agrees that their clothing and any containers they are carrying may be searched for this purpose.

10.2 The security service is entitled to refuse access to the premises to persons who pose a security risk.

10.3 The same applies to persons who refuse to consent to a search of their clothing and containers. The security service is also entitled to seize items that are not in accordance with the above paragraph, e.g. drugs, weapons, etc.

10.4 The security service is also entitled to carry out such checks on persons who are already on the premises.

11 Limitation of liability

11.1 Bergson Kunstkraftwerk is liable for all damages caused by culpable breach of a material contractual obligation or which are attributable to gross negligence or intent.

11.2 In the event of a breach of a material contractual obligation, liability for simple negligence is limited to the foreseeable damage typical for the contract.

11.3 Liability for injury to life, limb or health as well as liability under the Product Liability Act, liability for fraudulently concealed defects and liability for the assumption of a guarantee for the quality of an item shall remain unaffected.

11.4 Bergson Kunstkraftwerk is not liable for items handed over to its employees or otherwise deposited or left on the premises. No liability is accepted for items that are lost during a visit to the Bergson Kunstkraftwerk.

11.5 Bergson Kunstkraftwerk is not liable for the artistic content shown. All content shown is an expression of the artistic freedom of the respective artists. Parents are liable for their children.

12. damage reports

All facilities at Bergson Kunstkraftwerk are carefully maintained and monitored. Should you nevertheless suffer damage through no fault of your own, please report the damage to the information desk before leaving the premises.

13. domiciliary rights

The Bergson Kunstkraftwerk is entitled to expel persons who violate the house and parking lot rules at its own discretion without compensation.
